[P. 27.] Pro: N. Hamp'. At a Gen1 Assembly held at Portsm° by adjournm', Aug. 24, 1716. Present, The Hon'ble Geo: Vaughan, Esq., Lt. Gov', Rob Eliot, ? Sam' Penhallow, Esqs. John Wentworth, Esq. Sam' Penhallow, Esq., & ye Clerk was sent down to ye house of Representatives wth a vote for settling fees on ye officers of ye Admiralty, custom house & on ye naval officers; also to recommend to their consideration ye alteration of some of ye fees already settled. Mr. Marston brought up the following answ to yo Lt. GovTMs Speech, wth Such alterations as ye House of Representatives saw meet to make, since ye sd answer was left wth ye house to be reconsidered. He also brought up to ye board ye Councill's vote ab tunnage of vessels - not concurred wth. In Answer to his Honrs. Speech. We are sensible of ye duty incumbent on this house to provide for defraying ye publick charge of ye Prov: & to support ye hon & dignity thereof, which we are of opinion is most reasonable to be done by an equal tax on all p'sons & estates within the Same. We find pr. ye Journal of this house there has been Standing Committees from time to time, who have examined all ye treasurer's accounts, wch upon their return have been approved of & accordingly voted pr. ye Gen' Assembly; but all accounts Since such vote, we expect to inspect into, & desire yt ye treasurer lay them before this house seasonably; & that he forthwth make a calculation of what Sum of bills of credit of this Province have been omitted, what have been returned into ye treasury, what burnt, what repeated, & what lett out & to whom, & ye times limitted when ye whole is to be called in. [P. 28.] The Act already in being ab' swearing town officers, we are of opinion is sufficient, & as to calling town meetings, we think ye Law has made sufficient provision therefor; as also for paymt of ministers sallaries.* Pr. (1) After the first p: graph: "That this house doe not proceed on an Act of Impost for the ensuing y." (2.) After the third paragraph-"but, that there be An Act drawn up oblidging such town or parishes that shall willfully neglect to call and settle an orthodox minister, to pay toward the Support of ye ministry in the Town or Parish they sprang from, or to the neighboring Town, after six months such neglect." Mark Hunking, Esqs., were sent down to the house of Representatives to recommend to their consideration ye presenting his Hon' ye Lt. Gov' wth the sixty pounds wch would have been due to his Excellency Col. Dudley, had not Col. Vaughan published his Lt. Govt Commission & taken upon him ye administration of ye governm1. The Clerk was sent down to the house of Representatives with a vote for drawing up of forms & p'esidents for oaths, writts, summons, &c., in order to be printed. Mr. Marston brought up a vote to this board abt providing for Col. Shute's reception. Joseph Davis p'ferred a petition to ye Gen' Assembly for an Act to be passed for a special court, that he might have his tryal for accidentally killing a child. The petition being read at ye Councill board, it was sent down to yo house of Representatives pr. ye Clerk. Capt. Jno. Gillman brought the following vote to this board from ye house of Representatives concurred with. Voted, That there be p'sidents & forms of oaths, writts, summons, &c., considered and drawn up by a Committee of both houses in ord to be printed with ye body of Laws. R. Waldron, Cler. Con. Gillman came to this board, to pray in behalf of ye house of Representatives, yt whereas it was Saturday, & nothing lying before that house, that they might be dismist. The Clerk was sent down to ye house of representatives wth a vote of Councill for lodging ye bonds yt are ye security for ye mony lent out of ye Treasury, in some uninterested p'sons hands. Mr. Tibbets brought up ye following vote to this board, concurred with. In Councill. Voted, That the Committee appointed to supervise & collect a body of Laws for ye press, be ye Committee for drawing up y forms and p'sidents for oaths, writts, summons, &c. Augst 24, 1716. R. Wibird, Clerk. Mr Eastman brought up a vote to this board for Capt. Gerrish's keeping ye bonds given for ye security of ye mony lent out of y• Treasury, wch vote was returned by ye clerk not concurred wth. Prorogued to Wednesday, ye 12, 7br, 1716. [P. 30.] Pro: N. John Wentworth, Esq. Adjourned to to-morrow, 10 o'clock, A. M. S Pro: N. Hamp❜. [Met according to adj',-Present as before Except John Plaisted, Esq.] Mr. Sheriff Phipps made a representation to this Board of y deficiencies of ye Goal in writing; weh being read, was sent down to ye house of Representatives pr. ye Clerk. Tim Davis, jun', presented a Petition to this board, directed to y Gen' Assembly, against Walton Hull's becoming a banckrupt, wch being read was sent down to ye house of Representatives pr. ye clerk. Col. Smith brought back Tim' Davis's petition from ye house of Representatives, & gave ye opinion of that house (viz.), yt Walton Hull, ye sd Tim° Davis's Deb', could have no benefitt by ye Act abt banckrupts. The Clerk was sent down to ye house of Representatives wth a vote for swearing all town officers. Mr. Jn Gillman returned ye vote abt swearing town officers to this board, concurred wth, as follows: In Councill. [P. 31.] Voted, That all town officers for ye future shall be sworn before a Just of Peace, before they enter upon ye execution of their respective offices. Sam' Penhallow, Esqs. Mark Hunking Jno. The Clerk was sent down to ye house of Representatives with a vote for running all ye town bounds wthin this Province, weh vote was returned from ye house of Representatives to ye Councill board, not concurred wth,* pr. Mr. Epha Marston. The Clerk was sent down to ye house of Representatives with a vote abt ye reception of Col. Shute. Adjourned to to-morrow, 10 o'clock A. M. The following vote was passed by the House Sept. 13th. Voted, That ye bounds of each Town & parish within this Pro: shall be run & bounds Renewed once in three years; and that the Proprietors of all unfenced lands that are in common, shall run ye lines once in two years, the same to be done by ye Lot layers of each Town or Parish, under penalty, and the party refusing or neglecting shall forfeit twenty shillings for every neglect. Pr. order of the House. Pro: N. Hamp'. At a Gen Assembly held at Portsm°, by adjournm', Sept. 15th, 1716. His Hon y Lt. Gov' layed a memorial before this board, ab* settling new townships & running a highway from Kingston to Northfield. [P. 32.] Sam' Penhallow and Mark Hunking, Esqs., were sent down to the house of Representatives to lay ye memorial abt laying out new townships before the House, & to desire their speedy dispatch of any matters lying before them. The following vote was returned from ye house of Representatives to this board concurred with. In Councill. Voted, That Mr. Treasurer Penhallow make provision for the reception of Col. Shute, wh en shall arrive in this Governm', & yt mony be reserved in ye treasury therefor, (viz.) one hundred pounds, & yt those Gent appointed to wait on Col. Burgess,* in case he had come or Gover to congratulate him on his arrival, be desired in like manner to wait on Col. Shute, w" he shall arrive, to complim him in behalf of this governm*. The house of Representatives answer to ye sheriff's remonstrance abt y Goal, is, yt there is care already taken abt sd Goal, wch answer is on file, dated 7br 15, 1716. The house of Representatives sent up a vote to this board for suspending ye consideration of laying out a new highway to Northfield, & making new touns, till next sessions.
