much into shag, and how much into roll and carrot-tobacco ; and he shall, without delay, after weighed, manufacture the same according to such declaration and if any manufacturer shall begin, without giving such notice, or naving given such notice and begun to weigh, shall neglect or refuse to proceed, he shall forfeit 201. s. 77.

But he shall not incur the penalty of 201. for not pressing for cutting, or not spinning or making into carrots, any tobacco, according to such declaration, if it shall, upon further examination appear to be unfit, and notice thereof, in writing, specifying the weight, shall be given to the officer, within fortyeight hours after delivery of such declaration, and if the manu facturer shall also, within that time, deliver a fresh declaration in respect thereof, specifying into which sort of tobacco the same is to be manufactured, and shall proceed accordingly. s. 78. Nor shall such manufacturer, being also a manufacturer of snuff, incur the penalty for not proceeding according to such declaration, if such tobacco shall, upon exammation, appear to be unfit for the purpose, and fit only for being a down in snuff-work, and notice, specifying the weight, shall be riven to the officer, within forty-eight hours after the delivery of such declaration; and if such manufacturer shall also, within that time, deliver a fresh declaration in respect thereof, specifying into what sort of snuff-work the same is to be laid down, viz. whether for rappee, Scotch snuff, or brown Scotch snuff, and shall also proceed according to such last declaration.

And when the manufacturer shall have pressed, cured, and finished any rolls or carrots, he shall deliver to the officer a declaration, specifying the number and also the weight thereof, and keep them separate from all others, for twenty-four hours after, or until the officer shall have taken an account thereof, on pain of 50%. s. 82.

dye, or cure the same to resemble tobacco, or mix the same with tobacco, or sell, expose to sale, or have in his custody, any such leaves so cut, coloured or mixed, on pain to forfeit for each offence 2001 and all such leaves so cut, coloured, mixed, sold, or exposed to sale and all tobacco mixed therewith, together with the packages, shall and may be seized by any officer of cus toms or excise. s. 84.

But nothing herein shall prohibit any manufacturer from dying, or staining any tobacco manufacturing or manufactured into the above sorts with any liquid dye or stain, or from having such dye in his custody. 29 Geo. 3. c. 68. s. 85. 30 Geo. 3.

Every manufacturer of snuff, shall, at his own expence of snuff to pro. provide moveable casks for laying down the snuff-work and tovide moveable bacco stalks for tobacco-stalk flour, which he shall lay down casks to lay in casks; and also, like casks for putting therein, such as he down snuffshall lay down in any bin ; and he shall so construct such casks, that the officer may examine and weigh the same, and examine the contents thereof, at all times; and shall also mark each cask with a progressive number, and the exact tare thereof, and shall not lay down any snuff-work, in any cask not so marked, nor in any vessel, except a cask so marked, or in a bin, on pain of 5OL. s. 86.

And every manufacturer of snuff, shall before he begin to before they be- liquor, damp, strip, press, or cut any tobacco or stalks, or to gin any opera- lay down any snuff-work, or tobacco-stalks for tobacco-stalk flour, give to the officer six hours notice in writing, within the li mits of the chief office, twelve hours in any city or the suburbs thereof, or in any market town; and twenty-four hours notice in other parts, and in such notice shall specify the time, when he intends to begin, and the weight of the tobacco, stalks and returns, and the number of the cask or bin, on pain of 50%. s. 78.

And the officer shall attend pursuant to such notice; and the manufacturer shall, then, or within one hour after, begin to weigh all such tobacco and stalks, separate from each other, in the presence of such officer, and continue weighing, until all shall be weighed, on pain of 50%. and shall immediately after the same have been weighed, deliver to such officer a declaration in writing, specifying how much are intended to be made into rappee, how much into Scotch, how much into brown Scotch, and how much into flour, under the like penalty of 50l. and so soon as such snuff-work or tobacco-stalks shall be put into cask, such manufacturer shall give to the officer notice thereof in writing, specifying when the same were laid down, on pain also of 50%. and the officer shall attend pursuant to such notice; and such manufacturer shall, immediately thereon, in the presence of such officer,affix to each cask a ticket, specifying the number of such cask, the weight of the snuff-work or tobacco-stalks for flour therein, and the time when they were laid down; also whether

such snuff-work is intended to be manufactured into rappee, Scotch or brown Scotch snuff, on like pain of 50. which ticket shall be signed as well by such manufacturer, or his servant, with his name, as by such officer with his name. s. 87.

And it shall be lawful, for ma ufacturers of snuff, to add to The manner of any parcel in operation (once, whilst the same shall be laid down mixing or addin the cask or bin, or once immediately before or in the grinding thereof, or once at each of the operations, but not oftener) any quantity of tobacco, tobacco-stalks, tobacco-stalk flour and returns of tobacco, or either of them, upon giving to the officer previous notice in writing as before, specifying the cask, or bin, and the number thereof, in which such snuff-work shall then be, or out of which it has been taken, and the time when it was first laid down, and when any increase was made thereto, and the weights of the tobacco-stalks, flour, or returns, intended to be added to such snuff. 30 Geo. 3. c. 43. s. 11.

And he shall immediately on the officer's attendance or within one hour after, weigh all tobacco, &c. intended to be added, separately, in the presence of such officer, who shall take an account thereof, and he shall also immediately after, deliver to the officer a declaration in writing, specifying the weights in, tended to be added, the weights before laid down in or added to such snuff-work, and whether it is for rappee, Scotch, or brown Scotch snuff, and the time when it was laid down, and when any increase was made thereto. s. 12.

Also it shall be lawful for any manufacturer, who shall have laid down snuff-work in cure in several parcels, or at different times, to mix whilst the same remain in cure, the whole of one parcel with the whole of any other, and to proceed, as if the whole had been laid down in one parcel, and at one time: provided such parcels be mixed together, in the presence of the offi cer,upon a like notice, specifying the cask or bins, and the numbers thereof, and when such parcels were laid down, and the officer shall take an account thereof; and the manufacturer shall immediately after the same have been mixed, deliver a de claration in writing,specifying the weights laid down in each parcel, and the time when the same was so laid down in cure. s. 13. And when such manufacturer shall intend to take any snuff work, or tobacco-stalks for flour, out of such casks, for grinding, he shall give to the officer the same notice as before directed, and therein specify the particular cask, and the number thereof, and whether it is intended to be made into rappee, Scotch, or brown Scotch snuff; and the officer shall attend pursuant to such notice; and the manufacturer shall immediately weigh, in his presence, all such snuff-work or stalks, specified in the notice; and if the same shall be taken out of any cask in which there shall be any remaining, such manufacturer shall, immediately after, on pain of 50%. affix a ticket, signed by him or his servant, and by such officer, to such cask, specifying the weight

taken out, and the time when, and he shall on like pain, cause every ticket to be kept on each cask during all the time that any snuff-work or tobacco-stalks for flour shall remain therein; and he shall not mix any snuff work or tobacco-stalks for flour of one making with that of another; (except as is provided by the above statute of 30 Geo. 3. c. 40) 29 Geo. 3. c.-68. s. 87.

And if he shall lay down any snuff-work, or stalks for flour, or shall take any out of any such cask for grinding without giving such notice, or without the presence of the officer, or shall not weigh the same, in the presence of such officer, or shall mix any snuff work or stalks of one making with that of any other, except as above, he shall forfeit 501.29 Geo.3. c. 68.s.87.

And he may manufacture Scotch snuff and tobacco-stalk flour into brown Scotch snuff, and tobacco-stalk flour into rappee snuff, under the regulations of the act 29 Geo. 3. c. 68, and the act 30 Geo. 3. c. 40. s. 19.

And every manufacturer shall with all due diligence manufac ture all snuff-work, taken out of such cask, according to his notice, on pain of 50l. s. 89.

But no manufacturer shall be liable to the said penalty, for not manufacturing any snuff-work, according to his declaration, in case it shall appear unfit to be so manufactured, and notice thereof in writing, specifying the weight, shall be given to the officer within forty-eight hours, after the delivery of such deciaration, and in case he shall also, within that time in like manner deliver to the officer a fresh declaration in respect thereof, specifying into which of the sorts of snuff, the same is to be manu. factured, and shall also proceed to manufacture the same according to such last declaration. s. 88.

Also such manufacturer may give to the officer, from time to time, whilst such snuff-work shall be in the cask or bin, the like previous notice in writing, as is required before they lay down the snuff-work, of his intention to manufacture such snuff. work different from his former declaration, therein specifying the cask, or bin, and the number thereof, in which such snuffwork shall then be, the time when it was laid down or added to, and the purpose for which the same was before declared to be laid down; and he shall also within forty-eight hours after such notice, deliver to such officer a fresh declaration in writing, spe cifying the weight laid down, and whether the same, and how much thereof,is intended to be made into rappce Scotch,or brown Scotch snuff, and shall proceed without delay to manufacture the same, according to the last declaration. 30 Geo. 3. c. 40.

And when any manufacturer shall have finished the manufac turing of any snuff work into snuff, he shall on pain of 507, de liver to the officer a declaration in writing, specifying the weight of each sort and the weight of tobacco-stalk flour,if any, manu. factured into the same, and he shall on like pain of 50%. keep

such sorts apart from each other, and apart from all other snuff, and from all tobacco-stalk flour, for twenty-four hours, or until the officer shall have taken an account thereof. 29 Geo. 3: 4. 68. §. 89.

Nothing herein shall make any manufacturer liable to the penalty of fifty pounds, for not delivering such last declaration, for any Scotch snuff returned directly from the mill where ground, and deposited in such room as is hereinafter allowed, provided he previous to and immediately on taking such Scotch snuff out of such room, deliver to the officer a declaration specifying the weight thereof, and of the materials manufactured into the same, and the time when they were laid down in snuff.work. s. 90..

And every manufacturer of snuff may, at his own expence, Locking up provide a room for keeping dried Scotch snuff, with good fas. Scotch snuff. tenings, to be approved of in writing by the supervisors; and no such room shall have more than one entrance thereto, nor all there be any communication whatsoever except one door, between such room and any other; and such room shall be

up, sealed, and secured by the officer, at all times when any Scotch snuff shall be therein; and if the manufacturer intends to have the Scotch snuff ground from his snuff-work, returned directly from the mill where ground, and deposited in such room for not exceeding six months, he may so do, on giving the officer. it hours notice in writing, within the limits of the chief office; twelve in any city, or the suburbs thereof, or in any market ton; and twenty-four hours, in other parts; and such officer hall attend and open such room, and such Scotch snuff shall thea be immediately put therein, in the presence of such officer, and shall remain therein for not exceeding six months, without being deemed part of his stock, so as to deprive him of any part of the credit allowed to him, for Scotch snuff: and when he intends to take Scotch snuff out of such room, he shall in like Der give to the officer, like notice of his intention; and the of ficer shall attend and open such room, and the Scotch snuff shall then be immediately taken out in his presence, and the manufac arer shall keep all Scotch snuff, of one making separate from all of any other making in such room, on pain of 50l. s. 91. manufacturer, shall by any contrivance whatso ever, open any room so provided, except in the presence of the ofcer, he shall forfeit 2001. s. 92.

make or colour any snuff-work or snuff, with any sort of ochre,
umber, or any other kind of colouring (water tinged with colour
only excepted),
