AN ACT to make appropriations for the commissioner of pardons and paroles for the fiscal years ending June thirty, nineteen hundred twenty-six, and June thirty, nineteen teen hundred twenty-seven, for maintenance and operation.

The People of the State of Michigan enact:

SECTION 1. There is hereby appropriated from the general fund for the commissioner of pardons and paroles, for the fiscal year ending June thirty, nineteen hundred twenty-six, the sum of twenty-four thousand seven hundred twenty-one dollars, and for the fiscal year ending June thirty, nineteen hundred twenty-seven, the sum of twenty-three thousand three hundred seventy-one dollars, for the purposes and in the specific amounts as follows:

Each of said amounts shall be used solely for the specific purposes herein stated, subject to the general supervisory control of the state administrative board.

SEC. 2. The amounts hereby appropriated shall be paid out of the state treasury at such times and in such manner as is or may be provided by law.

SEC. 3. All fees or other moneys received by said commissioner of pardons and paroles shall be forwarded to the state treasurer each month and shall be by said treasurer deposited in the state treasury to be disbursed in such manner and for such purposes as may be provided by law.

This act is ordered to take immediate effect.

AN ACT to make appropriations for the state department of health for the fiscal years ending June thirty, nineteen hundred twenty-six, and June thirty, nineteen hundred twentyseven, for maintenance and operation.

There is hereby appropriated from the general Amounts fund for the state department of health, for the fiscal year ending June thirty, nineteen hundred twenty-six, the sum of three hundred twenty thousand four hundred twenty-five dollars, and for the fiscal year ending June thirty, nineteen hundred twenty-seven, the sum of three hundred twenty thousand four hundred twenty-five dollars, for the purposes and in the specific amounts as follows:

The People of the State of Michigan enact:

SECTION 1. There is hereby appropriated from the general fund for the state department of health-bureau of institutional health, for the fiscal year ending June thirty, nineteen hundred twenty-six, the sum of thirty-six thousand six hundred dollars, and for the fiscal year ending June thirty, nineteen hundred twenty-seven, the sum of thirty-six thousand six hundred dollars, for the purposes and in the specific amounts as follows:

AN ACT to make appropriations for the Michigan board of pharmacy for the fiscal years ending June thirty, nineteen hundred twenty-six, and June thirty, nineteen hundred twenty-seven, for maintenance and operation.

The People of the State of Michigan enact:

Each of said amounts shall be used solely for the specific purposes herein stated, subject to the general supervisory control of the state administrative board: Provided, That in no Proviso. case shall the expenditures of said board exceed the fees collected by it.

AN ACT to amend section one of act number one hundred fifty-nine of the public acts of nineteen hundred seventeen, entitled "An act to provide for writs of error in criminal cases on behalf of the people of the state of Michigan in certain instances."

The People of the State of Michigan enact:

SECTION 1. Section one of act number one hundred fifty-nine of the public acts of nineteen hundred seventeen, entitled "An act to provide for writs of error in criminal cases on behalf of the people of the state of Michigan in certain instances," is hereby amended to read as follows:

SEC. 1. A writ of error may be taken by and on behalf of the people of the state of Michigan from any court of record in said state direct to the supreme court thereof, in all criminal cases, in the following instances, to-wit:

(a) From a decision or judgment quashing or setting aside any indictment or information, or any count thereof, where such decision or judgment is based upon the invalidity or construction of the statute upon which such indictment or information is founded.

(b) From a decision arresting a judgment of conviction or directing a judgment of acquittal for insufficiency of the indictment, where such decision is based upon the invalidity or construction of the statute upon which such indictment or information is founded.

From the decision or judgment sustaining a special plea in bar, when the defendant has not been put in jeopardy, or from any other order of the court relative to admission of evidence or proceedings had or made at any time before the defendant is put in jeopardy.
