NEVADA LEGISLATURE---SENATE.

THIRD SESSION.

FIRST DAY.

CARSON CITY, January 7th, 1867.

Pursuant to the provisions of Section 12, Article 17, of the Constitution of the State of Nevada, the Senate was called to order by the Hon. J. S. Crosman, President, at 12 o'clock, noon.

The following named Senators answered to their names at roll call:

Messrs. Carpenter, Doron, Eastman, Edwards, Geller, Grey, Haines, Hastings, Hutchins, Linn, Mason, Meder, Monroe, Nelson, Proctor, Stevenson, Sumner, Terry, Welty.

The President appointed D. J. Gasherie, Sergeant-at-Arms pro tempore.

Mr. Proctor, of Nye, offered the following:

"To the President of the Senate:

"SENATE CHAMBER, January 7th, 1867.

"I object to the admission of George T. Terry to a seat in the Senate of Nevada, on the ground that at the time of his pretended election he was holding a lucrative office under the Government of the United States, and is therefore, under the Constitution of Nevada, ineligible to hold the office of State Senator now claimed by him."

Mr. Proctor contended that action thereon should be had before the oath of office was administered to Senators elect.

Mr. Welty raised the point of order, that the credentials of a claimant to a seat were prima facie evidence of his right to such seat.

The Chair ruled the point well taken, and that the Senate could only properly determine the right to a contested seat after full organization.

Messrs. C. Carpenter, of Lyon County, Lewis Doron and B. S. Mason, of Esmeralda, C. H. Eastman and Sol. Geller, of Washoe, T. D. Edwards and B. H. Meder, of Ormsby, O. H. Grey, John Nelson, and C. C. Stevenson, of Storey, J. J. Linn, of Humboldt, W. G. Monroe, of Churchill, and George T. Terry and D. W. Welty, of Lander, presented their certificates of election, and each took the oath of office and of secrecy, administered by the Hon. H. O. Beatty, Chief Justice.

Mr. Hutchins moved to proceed to the election of a President pro tempore. Carried.

Mr. Haines placed in nomination Senator Lewis Doron.
Mr. Edwards placed in nomination Senator C. A. Sumner.
Nominations were declared closed.

The roll was called, with the following result:

For Mr. Doron: Messrs. Haines, Hastings, Mason, Meder, Sumner and Welty-6.

For Mr. Sumner: Messrs. Carpenter, Doron, Eastman, Edwards, Geller, Grey, Hutchins, Linn, Monroe, Nelson, Proctor, Stevenson and Terry-13. Whole number of votes cast-19.

Necessary to a choice-10.

Mr. Sumner, having received a majority of all votes cast, was declared elected President pro tem.

On motion, the Senate proceeded to the election of Secretary.

Mr. Welty nominated B. C. Brown.

Mr. Hastings nominated Wm. M. Cutter.

The roll was then called, with the following result:

For Mr. Brown: Messrs. Doron, Eastman, Edwards, Geller, Grey, Haines, Hutchins, Mason, Meder, Monroe, Nelson, Proctor, Stevenson, Sumner, Terry and Welty-16.

For Mr. Cutter: Messrs. Carpenter, Hastings and Linn-3.

Whole number of votes cast-19.

Necessary to a choice-10.

Mr. Brown, having a majority of all votes cast, was declared duly elected.

The Senate then proceeded to the election of a Sergeant-at-Arms.

Mr. Nelson nominated Mr. Vandewater.

Mr. Grey nominated Mr. Gaige.

Mr. Hastings nominated Mr. Munckton.

Mr. Edwards nominated Mr. Gasherie.

The roll was then called, with the following result:

For Mr. Vandewater: Mr. Linn and Mr. Nelson-2.

For Mr. Gaige: Messrs. Carpenter, Doron, Edwards, Geller, Grey, Haines, Mason, Meder, Monroe, Proctor, Stevenson, Sumner, Terry and Welty-14. For Mr. Gasherie: Messrs. Eastman, Hastings and Hutchins-3.

Whole number of votes cast-19.

Necessary to a choice-10.

Mr. M. M. Gaige, having received a majority of all votes cast, was declared duly elected.

The Senate then proceeded to the election of Enrolling Clerk.

Mr. Welty nominated John R. Williamson.

There being no other nominations, Mr. Williamson was, by acclamation, declared unanimously elected.

The Senate then proceeded to the election of Engrossing Clerk.

Mr. Hutchins nominated Wm. H. Williams.

Mr. Doron nominated John D. Gorin.

The roll was then called, with the following result:

For Mr. Gorin: Messrs. Carpenter, Eastman, Edwards, Geller, Gray, Haines, Mason, Meder, Monroe, Stevenson, Sumner, Terry, Welty-13.

For Mr. Williams: Messrs. Doron, Hastings, Hutchins, Linn, Nelson, Proctor-6.

Whole number of votes cast-19.

Necessary to a choice-10.

Mr. Gorin, having received a majority of all votes cast, was declared duly elected.

The Senate then proceeded to the election of Chaplain.

Mr. Edwards nominated the Rev. Mr. Stump. No other nominations being made, Mr. Stump was declared duly elected by acclamation.

Mr. Sumner offered the following resolution:

Resolved, That Wm. M. Cutter be, and he is hereby elected Official Reporter of the Senate.

Unanimously adopted.

Mr. Welty offered a concurrent resolution relative to the ceremonies of inauguration of the 8th inst.

Laid on the table temporarily.

B. C. Brown, Secretary; M. M. Gaige, Sergeant-at-Arms; J. R. Williamson, Enrolling Clerk; and John D. Gorin, Engrossing Clerk, took the oath of office and of secrecy administered by Chief Justice H. O. Beatty.

The Secretary read the following notices of appointments :

To the Hon. the Senate:

The Senate took a recess of fifteen minutes.

Roll called; quorum

On motion, Senate Concurrent Resolution No. 1, relative to the ceremonies of inauguration, was taken from the table. The roll was called on the passage thereof, with the following result:

YEAS-Messrs. Carpenter, Doron, Eastman, Edwards, Geller, Grey, Haines, Hastings, Hutchins, Linn, Meder, Nelson, Proctor, Stevenson, Sumner, Terry and Welty-17.

Passed.

Mr. Terry offered a concurrent resolution, relative to a joint committee, to wait on the Governor.

Laid on the table.

In pursuance of the requirements of Senate Concurrent Resolution No. 1, relative to the ceremonies of inauguration, the President appointed Messrs. Welty, Stevenson and Hastings a committee to make arrangements for the inauguration.

Mr. Hutchins offered the following resolution :

Resolved, That a Committee of two be appointed to inform the Governor that the Senate is now fully organized, and ready to receive any communication he may desire to make.

Adopted.

The President appointed Messrs. Hutchins and Eastman as such committee.

NOTICE OF BILLS.

Mr. Welty gave notice of his intention to introduce a bill entitled "An Act to amend an Act entitled an Act to redistrict the State of Nevada into Judicial Districts, and to fix the salaries of Judges and the terms of Court therein." Also, a bill entitled "An Act concerning incomplete service by publication of writs and process in certain cases." Also, a bill entitled "An Act to provide for the release of sureties on official bonds."

Also, a bill entitled "An Act defining the jurisdiction of the Courts in this State, where the venue is brought in question."
