IN SENATE-TENTH DAY.

CARSON CITY, January 16th, 1867.

The Senate met, pursuant to adjournment, the President in the chair.

Roll called.

Present-Messrs. Carpenter, Doron, Eastman, Edwards, Geller, Grey, Hastings, Hutchins, Linn, Mason, Meder, Monroe, Nelson, Proctor, Stevenson, Sumner, Terry, and Welty-19.

Prayer by the Chaplain.

The Journal of the Ninth day was read and approved.

REPORTS OF STANDING COMMITTEES.

Mr. Hutchins, from the Standing Committee on Military and Indian Affairs, to which was referred Senate Concurrent Resolution No. 18, in regard to establishing a military post at the junction of the north fork with the Humboldt River, reported that they had had the same under consideration, had come to a favorable conclusion thereon, and directed their chairman to report the same to the Senate with amendments, and recommend its passage.

Mr. Hastings reported that the Standing Committee on Engrossment had carefully compared the following entitled bill, and found the same correctly engrossed, viz: Senate Joint Resolution No. 25, in regard to Indian claims in Humboldt County; and herewith report the same back to the Senate.

MESSAGES FROM THE ASSEMBLY.

The following Messages were received from the Assembly:

I am directed to return to your honorable body Senate Concurrent Resolution No. 20, ordering the printing of the Report of Warden of State Prison; also, Senate Concurrent Resolution No. 21, in relation to printing Report of State Mineralogist, the same having passed the Assembly this day unanimously.

I also transmit to your honorable body for your consideration Assembly Joint Resolution No. 4, relative to daily mail from Virginia City, Nevada, to Boise City, Idaho.

Also, Assembly Joint Concurrent Resolution No. 10, relating to the election of United States Senator, the same having passed the Assembly this day.

I also return Senate Concurrent Resolution

relative to printing Governor's Message, the same having passed the Assembly this day unanimously.

Mr. Welty gave notice that he would, on some future day, introduce a Bill entitled "An Act to provide for the Selection and Sale of the Public Lands donated to this State for various purposes, and for the proper application of the proceeds of the sale thereof."

Mr. Mason gave notice that he would, on some future day, ask leave to introduce a Bill for an Act entitled "An Act to amend an Act entitled 'An Act to regulate the settlement of the Estates of Deceased Persons,' approved November 29th, 1861."

INTRODUCTION OF BILLS.

Mr. Welty, by leave, introduced Senate Bill No. 35, entitled "An Act to amend an Act entitled An Act concerning Fines and Punishments."" Read first time; rules suspended; read second time by title, and referred to Committee on Judiciary.

Read third time, and passed by the following vote:

Senate Concurrent Resolution No. 19, in relation to the boundaries of the State of Nevada, and the acceptance of additional territory, ceded by the United States to this State. Read third time, and passed by the following

Haines, Hastings, Hutchins, Linn, Mason, Meder, Monroe, Nelson, Proctor, Stevenson, Sumner, Terry, and Welty-19.

Mr. Hutchins, by leave, introduced Senate Concurrent Resolution No. 36, in relation to joint convention for election of United States Senator. Read and passed unanimously.

Senate Joint Resolution No. 25, in regard to Indian claims, in Humboldt County, read third time, and passed by the following vote:

YEAS-Messrs. Carpenter, Doron, Eastman, Edwards, Geller, Grey, Hastings, Hutchins, Linn, Mason, Meder, Monroe, Nelson, Proctor, Stevenson, Sumner, Terry, and Welty-18.

Senate Bill No. 5, entitled "An Act providing for the Release of Sureties on official bonds and undertakings."

A substitute therefor was reported by the Committee on Judiciary, which was adopted, and two hundred and forty copies ordered printed.

Senate Bill No. 11, entitled "An Act to amend an Act, entitled 'An Act to Provide Revenue for the Support of the Government of the State of Nevada, and the Acts amendatory thereof.'"

The usual number of copies ordered printed.

Senate Concurrent Resolution No. 18, memorializing the Commander of the Department of the Pacific to establish a fort at Gravelly Ford.

Ordered engrossed.

Assembly Joint Resolution No. 4, relative to a daily mail from Virginia City, Nevada, to Boise City, Idaho.

Read first time; rules suspended; read second time by title.

Rules further suspended, and the resolution placed on its third reading, and final passage.

Passed by the following vote:

YEAS-Messrs. Carpenter, Doron, Eastman, Edwards, Geller, Grey, Hastings, Hutchins, Linn, Mason, Meder, Monroe, Proctor, Stevenson, Sumner, Terry, and Welty-17.

Assembly Joint Concurrent Resolution No. 10, in relation to the election of a United States Senator, read, and on motion of Mr. Hutchins, laid on the table.

At 11:50 A.M., on motion of Mr. Proctor, the Senate took a recess, to meet at twelve o'clock in the Assembly Chamber, in joint convention.

IN JOINT CONVENTION.

Proceedings of Joint Convention, to elect a United Senator to succeed the Hon. James W. Nye, whose term of office will expire on the third day of March, 1867.

The Convention was called to order by the President of the Senate, in conjunction with the Speaker of the Assembly.

The Roll of the Senate, and also of the Assembly, was called, and all the members were present.

Such portions of the Journals of each House of the preceding day as pertained to the election of United States Senator, were read.

Mr. Edwards moved that the rule be suspended, and that the official Reporters of both Houses be admitted to seats within the bar.

Carried unanimously.

The following nominations were before the Convention: James W. Nye, Charles E. De Long, John B. Winters, Thomas Fitch, and Thomas H. Williams. Mr. Monroe, by leave, withdrew the name of Thomas H. Williams. Mr. Hastings, by leave, withdrew the name of John B. Winters. The roll was then called, with the following result:
