same date to the New York Municipal Railway Corporation. Contract No. 4 was modified by "Modifying Agreement No. 4. Contract No. 4," between The City of New York, by the Public Service Commission for the First District, and the New York Municipal Railway Corporation and the New York Consolidated Railroad Company, executed December 19, 1917; and the certificate for additional tracks was likewise modified by a certificate granted by the Public Service Commission for the First District to the New York Consolidated Railroad Company and the New York Municipal Railway Corporation on the same date. The modifying agreement provided for: (a) the construction of the Ashland Place Connection; (b) the construction of an additional station on the Willoughby Street line at or near Lawrence street; (c) the construction of a transfer connection between the Myrtle Avenue Elevated line and the Myrtle Avenue station of the Fourth Avenue subway, and (d) the construction of an additional station on the Brooklyn plaza of the Williamsburg bridge. The modifying certificate provided for an extension of time to begin the third tracking of the Fulton Street line below the point of junction with the Ashland Place Connection until one year after notice.

The Commission has obtained a sufficient number of the property owners' consents to legalize Route No. 65.

The Flushing route (Route No. 52) was modified in order to conform to the changes effected in the street system of the Second and Third Wards of the Borough of Queens. The Commission adopted the modification of said route by resolution of April 18, 1917, but upon the request of the Bureau of Franchises of the Board of Estimate and Apportionment the resolution of April 18, 1917, was rescinded, and a new resolution was adopted on April 27, 1917, so as to permit of the inclusion therein of the date of approval by the Board of Estimate and Apportionment of the changes in the street system above mentioned. The modification of said route was approved by the Board of Estimate and Apportionment of The City of New York on May 4, 1917, and by the Mayor on May 18, 1917.

The modification of the Southern Boulevard and Whitlock Avenue Route (Route No. 22) was adopted in order to provide a connection at Hunt's Point road between said route and the New

York, Westchester & Boston Railway and The New York, New Haven & Hartford Railroad. Said modification was adopted by the Commission by resolution of December 19, 1917, and has not yet been acted upon by the Board of Estimate and Apportionment of The City of New York.

ROUTE NO. 65

Ashland Place Connection

Adopted by the Commission February 16, 1917. Approved by the Board of Estimate and Apportionment June 15, 1917, and by the Mayor June 27, 1917. The route as adopted is described as follows:

ROUTE

The route shall lie within the Borough of Brooklyn and shall begin at a point over Fulton Street at or near Vanderbilt Avenue, where a connection can conveniently be made with the existing elevated railroad in Fulton Street, altered and reconstructed as may be necessary for that purpose; and thence shall run northwesterly as a three track elevated railroad over and along Fulton Street, occupying if necessary private property on either or both sides of Fulton Street, to a point at or near Clermont Avenue; and thence shall continue northwesterly as a three track railroad along Fulton Street, occupying if necessary private property on either or both sides of Fulton Street, partly as an elevated structure, partly upon embankment and partly in open cut to a point at or near Cumberland Street, where the route will become a subway or tunnel; and thence shall continue northwesterly as a four track railroad in subway or tunnel under and along Fulton Street to a point between South Elliot Place and Fort Greene Place, where the tracks will diverge. One track shall continue from said point of divergence northwesterly in subway or tunnel under and along Fulton Street to a point between St. Felix Street and Ashland Place, where a connection can conveniently be made with the existing Fourth Avenue Rapid Transit Railroad; and four tracks shall continue and curve from said point of divergence in subway or tunnel in a general westerly direction under Fulton Street into Lafayette Avenue, occupying if necessary private property on the southwest side of Fulton Street and the south side of Lafayette Avenue, between South Elliot Place and Fort Greene Place, and shall continue under and along Lafayette Avenue to a point at or near St. Felix Street, where the tracks will again diverge. From said point of diversion under Lafayette Avenue four tracks shall continue westerly in subway or tunnel under Lafayette Avenue to the easterly line of Ashland Place, where a connection can conveniently be made with a proposed rapid transit railroad to be hereafter constructed under and along Lafayette Avenue; and from said point of divergence one track shall continue and curve in subway or tunnel in a general northwesterly direction under Lafayette Avenue to a point

in private property on the northerly side of Lafayette Avenue in the block bounded by Lafayette Avenue, Fulton Street, St. Felix Street and Ashland Place, and thence shall continue under private property in said block to a point in Ashland Place between Lafayette Avenue and Fulton Street; and thence shall continue under Ashland Place to a point in private property on the westerly side of Ashland Place in the block bounded by Ashland Place, Fulton Street, Rockwell Place and Lafayette Avenue; and thence shall continue in a general northwesterly direction under private property in said block bounded by Ashland Place, Fulton Street, Rockwell Place and Lafayette Avenue to a point in Fulton Street between Ashland Place and Rockwell Place; and thence shall continue under Fulton Street to a point between Ashland Place and Rockwell Place, where a connection can conveniently be made with the existing Fourth Avenue Rapid Transit Railroad.

GENERAL PLAN OF CONSTRUCTION

The general plan of construction hereby adopted for the foregoing route is as follows:

For the portion of the route from the point of beginning at or near Vanderbilt Avenue and extending thence along Fulton Street to the point at or near Cumberland Street, where the route will become a subway or tunnel, there shall be three tracks. For the portion of the route from said point under Fulton Street at or near Cumberland Street, where the route will become a subway or tunnel; and extending thence under and along Fulton Street to the point between South Elliot Place and Fort Greene Place, where the tracks will diverge, there shall be four tracks. For the portion of the route from said point of divergence in Fulton Street and extending thence under and along Fulton Street to the point between St. Felix Street and Ashland Place where a connection can conveniently be made with the existing Fourth Avenue Rapid Transit Railroad there shall be one track. For the portion of the route from said point of divergence in Fulton Street and extending thence under Fulton Street into and along Lafayette Avenue to a point at or near St. Felix Street, where the tracks will again diverge, there shall be four tracks. For the portion of the route from said point of divergence under Lafayette Avenue and extending thence under Lafayette Avenue to the easterly line of Ashland Place, where a connection can conveniently be made with a proposed rapid transit railroad to be hereafter constructed under and along Lafayette Avenue, there shall be four tracks. And for the portion of the route from said point of divergence in Lafayette Avenue and extending thence under Lafayette Avenue, private property, Ashland Place, private property and Fulton Street to the point in Fulton Street between Ashland Place and Rockwell Place where a connection can conveniently be made with the existing Fourth Avenue Rapid Transit Railroad there shall be one track. The tracks for the portion of the route from the point of beginning at or near Vanderbilt Avenue and thence extending over and along Fulton Street to a point at or near Clermont Avenue shall be carried upon an elevated structure or viaduct. The tracks for the portion of the route from said point at or near Clermont Avenue and extending thence along Fulton Street to the point at or near Cumberland Street, where the route will
