KINGS COUNTY ELEVATED.

(Date of charter, January 6, 1879; by organization.)

NOT IN OPERATION.

The name of this incorporation by law is the Kings County Elevated Railway Company. It is organized in pursuance of what is known as the Rapid Transit Act, passed by the Legislature of the State of New York in 1875. The requirements of that act and of the commissioners' proceedings thereunder have been conformed to and complied with by the company, but the beginning of the actual construction of the railways has been delayed by proceedings in law and otherwise, not incurred by the action of the company. A consent of the municipal authorities respecting the routes of the company was given by the resolutions of the board of aldermen of the city of Brooklyn, finally, on the 31st day of December, 1883, and those resolutions were approved by the mayor, January 10, 1884. The decision of the Court of Appeals, recently rendered, has for the first time defined and settled the rights of the owners of land adjoining the street routes of elevated railways within a municipality. The purport and effect of that decision seem to require the company not only to get the consents of such adjoining owners but by agreement, or in the manner prescribed by statute, to make compensation to them as and when the use of streets is taken. The company has been for some time and is now diligently acquiring such consents and making arrangements, so far as it reasonably can, with such owners for lawful and proper compensation. Upon ascertaining the measure of proper compensation, so that the company can calculate an approximate amount of damages to be paid to such owners, it is prepared to begin the actual erection and construction of the railways according to the obligations of its charter and franchises, and complete the work and have the railways in operation within the time therein specified.
