required by section three of this Chapter, including the cause of death and the name of the physician last in attendance upon the deceased, immediately to the town or city clerk or registrar of the town or city in which the death occurred. He shall also within two days thereafter notify the physician last in attendance upon the deceased person of the name and date of death of the same. Whenever the body of a person is lying dead in any town or city who has been unattended by physician in his or her last sickness, the town or city clerk, or in the city of Providence the city registrar, shall call upon a registered physician or the medical examiner of the district in which the remains are lying, to inquire into and to certify as to the cause and manner of death, and shall allow to said physician or medical examiner the fee of two dollars which shall be paid out of the town or city treasury of said town or city upon the order of said town or city clerk or registrar: and provided, further, that whenever the medical examiner is called and finds upon inquiry that the case is within the provisions of Chapter 287 of the General Laws his services shall be rendered and fees paid in accordance with the provisions of said Chapter 287."

CHAPTER 453.

Passed May 18, AN ACT IN AMENDMENT OF CHAPTER 111 OF THE GENERAL LAWS ENTITLED "OF DOGS."

1897.

City council of Providence to fix fees of special constables for listing dogs.

It is enacted by the General Assembly as follows:

SECTION 1. Section 12 and 13 of Chapter 111 of the General Laws, entitled "Of Dogs," are hereby amended to read as follows:

"SEC. 12. The town sergeant of each town, or such special constables as the town council of such town may appoint annually in the month of April, shall ascertain and make a list of the owners or keepers of dogs in such town and return such list to the town clerk on or before the last day of May, and shall receive from the town treasury the sum of twenty

cents for each dog so listed, except in the city of Providence, where such special constable shall receive from the city treasurer such sum as may be fixed by the city council of said city for each dog so listed; and the town clerk shall within two weeks thereafter, furnish to the town sergeant or to each special constable so appointed and sworn, a list of all dogs licensed for the current year and a list of those not licensed, with the names of the owners or keepers thereof, and shall, except in the cities of Newport and Providence, post such list in at least three public places in the town or publish the same in such other manner as the town council may direct."

"SEC. 13. Any person may, and every such special constable so appointed and police officer and constable shall, kill or destroy or cause to be killed or destroyed, all dogs going at large and not licensed and collared according to law; and for each dog so killed, destroyed and buried, such special constable shall be entitled to receive from the town or city treasurer the sum of two dollars, except in the city of Providence where he shall receive from the city treasurer such sum as may be fixed by the city council of said city.'

CHAPTER 454.

AN ACT IN AMENDMENT OF CHAPTER 279 OF THE GENERAL Passed May 14, LAWS, "OF OFFENCES AGAINST PRIVATE PROPERTY."

It is enacted by the General Assembly as follows:

SECTION 1. Section 10 of Chapter 279 of the General Laws, entitled "Of offences against private property," is hereby amended by adding thereto the following words: "and every person who shall at any time break and enter any railroad car or break any lock or seal thereon with intent to commit larceny or other crime shall be imprisoned not exceeding two years."

SEC. 2. This act shall take effect from and after its passage.

CHAPTER 455.

Passed May 14, AN ACT IN AMENDMENT OF CHAPTER 281 OF THE GENERAL LAWS. "OF OFFENCES AGAINST CHASTITY, MORALITY AND DECENCY."

It is enacted by the General Assembly as follows:

SECTION 1. Whoever imports, prints, publishes, sells, or distributes a book, pamphlet, ballad, printed paper or other thing containing obscene, indecent or impure language, or manifestly tending to the corrup tion of the morals of youth, or an obscene, indecent, or impure print, picture, figure or description, manifestly tending to the corruption of the morals of youth, or introduces into a family, school, or place of education, or buys, procures, receives or has in his possession any such book, pamphlet, ballad, printed paper, print, picture, figure or other thing, either for the purpose of sale, exhibition, loan or circulation, or with intent to introduce the same into a family, school or place of education, shall be punished by imprisonment not exceeding two years, or by fine not exceeding one thousand nor less than one hundred dollars.

SEC. 2. When a person is convicted under the provisions of section one of this act and sentenced to pay a fine, one-half of the fine actually paid by such offender shall be paid to the person who informed and prosecuted such offender to conviction.

SEC. 3. So much of Chapter 281 inconsistent herewith is hereby repealed.

CHAPTER 456.

Passed May 18, AN ACT TO REGULATE THE WIDTH OF TIRES UPON VE1897. HICLES USING THE HIGHWAYS OF THE STATE.

It is enacted by the General Assembly as follows:

SECTION 1. From and after the first day of April, A. D. 1902, no vehicle shall be driven or used on any

highway in this state unless the width of the tires on each of the wheels of such vehicle shall be proportioned to the size of the axle of such vehicle as follows: the word axle as used in this act shall be deemed to mean an axle of iron or steel, or of other material not greater in load carrying capacity; the axle measurements herein mentioned shall be deemed to mean the size in inches of either the diameter or the square of the axle at the shoulder thereof, and the word tire shall be deemed to mean a flat smooth band or hoop of iron or steel; the proportion herein before referred to shall be as follows:

SEC. 2. No vehicle which shall, subsequent to the first day of April, A. D. 1898, be provided with a new wheel or wheels, and no vehicle the wheel or wheels of which shall, subsequent to said date, be new rimmed with either bent rims or piece felloes, shall be driven or used on the highways in this state, unless the tire on the wheel or wheels thereof are proportioned to the sixe of axle thereof as provided in section one of this

act.

SEC. 3. This act shall not apply to the apparatus Exceptions. of fire departments, nor to vehicles used upon rails or tramways laid in the highways, or carriages with rubber tires.

SEC. 4. It is enacted by the General Assembly as follows:

SECTION 1. The fees of deputy sheriffs for actual attendance upon either division of the supreme court

shall be three dollars for each day.

SEC. 2. This act shall take effect immediately.

CHAPTER 458.

Passed May 19, AN ACT IN AMENDMENT OF CHAPTER 118 OF THE GENERAL LAWS, "OF THE PROTECTION OF NAVIGATION”

It is enacted by the General Assembly as follows:

SECTION 1. Section 15 of Chapter 118 of the General Laws is hereby amended so as to read as follows:

"SEC. 15. The members of the board of harbor annual salaries commissioners shall be allowed six hundred dollars each as an annual salary, which shall be paid quarterly upon the order of the state auditor upon the general treasurer."

SEC. 2. All acts and parts of acts inconsistent herewith are hereby repealed, and this act shall take effect from and after its passage.
