CHAPTER 1,680.-[No. 56.]

AN ACT to legalize the Ordinance passed in the Constitutional Convention, called An Ordinance to provide for the Means of Defraying the Expenses of this Convention.

SECTION 1. The people of the State of Florida, represented in Senate and Assembly, do enact as follows: That the following clared legal. ordinance of the Constitutional Convention, which passed that body February 21st, 1868, be, and the same is hereby, made and declared to be of full effect and legal force, and all the provisions thereof binding as law, to wit: That this Convention does hereby levy and assess a tax of one-fifth of one per cent. on all taxable property of this State for the purpose of defraying the expenses of this Convention and the compensation of officers and members thereof, and it shall be the duty of the tax collector in the several counties of this State to collect the same on or before the first day of January A. D. 1869, and to pay the same to the Treasurer of the State immediately upon the collection thereof, and that the collector shall collect the same as in accordance with the laws of the State of Florida for the collection of State taxes.

SEC. 2. That the Comptroller shall issue to the tax collectors all necessary orders for the collection and payment of the afore- duty. said tax, which order shall be binding upon the tax collectors. SEC. 3. That the tax collectors shall receive the same per cent. as they are now allowed by law for collecting the State tax.

SEC. 4. That the Governor of this State is hereby empowered and authorized to issue bonds bearing eight per cent. interest issued and sold. per annum, payable upon the first day of March, A. D. 1869, in such sums as he may deem expedient, not exceeding in amount thirty thousand dollars, which shall be redeemed out of the proceeds of said special tax when collected, and the financial agent, for the purpose of defraying the immediate expenses of this Contion, is hereby empowered to dispose of the said bonds, and to pay from the proceeds thereof such accounts as may be audited by the finance committee, and deposit the balance, if any, with the Treasurer of the State.

SEC. 5. That the Governor of the State of Florida is hereby requested, authorized, and directed to issue certificates of in- indebtedness to debtedness to the full amount of ten thousand dollars, which certificates of indebtedness shall be receivable for the tax levied under this ordinance, and all State dues. Said certificates shall bear the impress of the seal of the State Treasurer, and shall be in such amounts as the Governor may deem expedient.

AN ACT to authorize the Governor of this State to raise Funds to Pay the Expenses of the present Legislature.

The people of the State of Florida, represented in Senate and Assembly, do enact as follows: SECTION 1. That the Governor Governor may of this State be, and he is hereby, authorized to sell or hypothecate, at current market rates, the Virginia, North Carolina, Charleston City, and Tennessee bonds in the treasury, substituting therefor the bonds of the State of Florida.

AN ACT to raise Additional Revenue for the State.

The people of the State of Florida, represented in Senate and Assembly, do enact as follows. SECTION 1. That from and after Tax upon the date hereof, there shall be levied, collected, and paid the following tax upon all commissions issued to officers appointed by the Governor and confirmed by the Senate, under the constitution and laws of the State, which tax shall be first paid by the officer appointed before he shall be entitled to receive his commission, or enter upon the duties of his office, to wit: Upon Several the commission of the Chief-Justice of the Supreme Court, $75.00; upon each commission as an Associate Justice, $70.00; upon each commission as a Circuit Judge, $60.00; upon each commission as an officer of the Cabinet, $50.00; upon each commission as a State's Attorney, $30.00; upon each commission as a County Judge, a Clerk of the Circuit Court, and a Sheriff, $10.00; upon each commission as an Assessor of Taxes, and a Collector of Revenue, $5.00; upon each commission as a County Treasurer, a County Surveyor, a Superintendent of Common Schools, a County Commissioner, and a Justice of the Peace, $1; and upon all other commissions not above enumerated, $1.00.

AN ACT to provide for the Payment of the Members, Officers, Attaches, and other Expenses of the First Legislature held under the Constitution of the State of Florida.

Preamble.

WE WHEREAS, Section four of Article sixteen of the Constitution of the State of Florida provides that each Senator and Assemblyman shall be paid five hundred dollars per annum for their services as such Senators or Assemblymen, and in addition thereto ten cents per mile for each mile actually travelled; AND WHEREAS, The present General Assembly have done and performed the work of the annual session of the Legislature for the year one thousand eight hundred and sixty-eight; SECTION 1. Therefore, the people of the State of Florida, represented in Senate and Assembly, do enact [as follows:] That the Comptroller of the State of Florida be, and is hereby, authorized, low annual salempowered, and required to audit and allow the account of each ary. Senator and Assemblyman attendant upon this Legislature, the full amount of their annual salary, to wit: Five hundred dollars, and ten cents a mile for each mile actually travelled.

SEC. 2. That the Comptroller, as aforesaid, be authorized, empowered, and required to audit and allow the account of each member of the Senate and Assembly for mileage, certified to upon honor by said member and countersigned by the Chairman of the Committee of Legislative Expenses of either House.

SEC. 3. That the Comptroller, as aforesaid, be authorized, empowered, and required to audit and allow the account of each clerk, attache, and public printer of either House, Senate or Assembly, for services rendered to the State of Florida, for attendance upon the Legislature; Provided, The same be certified to upon honor by the claimant, and countersigned by the Chairman of the Committee on Legislative Expenses of either House. SEC. 4. That the said Comptroller be authorized, empowered, and required to audit and allow the accounts as aforesaid, for which he shall make and deliver to each Senator, Assemblyman, Attache, and Public Printer, a draft on the Treasurer of the State of Florida for the amount found to be due each as aforesaid; that the Comptroller's draft or drafts issued as aforesaid

AN ACT to make Appropriation for the Expenses of the State Government of the State of Florida, for the fiscal year ending thirty-first day of December, one thousand eight hundred and sixty-eight.

SECTION 1. The people of the State of Florida, represented in Senate and Assembly, do enact [as follows:] That the followExpenses ing amounts be, and the same are hereby, appropriated for the State Govern- purposes herein designated, to pay and defray the expenses of the State government of the State of Florida for the fiscal year ending thirty-first day of December, one thousand eight hundred and sixty-eight, to wit: For salaries of Governor, LieutenantGovernor and other public officers, seventeen thousand dollars; salaries of Justices of Supreme and Judges of Circuit Court, twenty thousand dollars; salaries of State's attorneys, four thousand dollars; salaries of members of the Legislature, thirty-eight thousand dollars; for mileage for same, four thousand dollars; for pay of secretaries, clerks, attaches, and chaplain of Senate, and clerks, officers, attaches, and chaplain of Assembly, twelve thousand dollars; for pay for stationery for use of Legislature, four thousand dollars; for contingent expenses of Supreme Court, one thousand five hundred dollars; for contingent expenses of Circuit Courts, two thousand dollars; for contingent fund for State, ten thousand dollars; for contingent fund for Governor, ten thousand dollars; for the pay of jurors and State witnesses, fifteen thousand dollars; public miscellaneous printing and printing laws, nineteen thousand dollars; for clerk of Supreme Court, two thousand dollars; post mortem examination, five hundred dollars, and for repairs to capitol, one thousand dollars; for organizing, equipping, and arming militia of the State of Florida, ten thousand dollars.

SEC. 2. That an additional appropriation is hereby made for Per diem the following purposes, to wit: For payment of per diem of judges of the county courts in this State, eight thousand dollars ($8,000.)

JOINT RESOLUTION instructing Secretary of State to investigate accounts of Printers.

Resolved, That the Secretary of State be, and he is hereby, authorized and instructed to investigate the accounts for printing for the late Constitutional Convention, as rendered by Messrs. Constitution a 1 Dyke & Sparhawk, and J. B. Oliver, and report to the next session of the Legislature the amount claimed, the amount paid, and the excess above a reasonable. and fair compensation; and that for this purpose he have power to send for persons and papers, and compel the attendance of witnesses. JOINT RESOLUTION to adopt a Seal for the State.

Be it resolved by the Senate and Assembly of the State of Florida, That a seal of the size of the American silver dollar, having in the centre thereof a view of the sun's rays over a highland in the distance, a cocoa tree, a steamboat on water, and an Indian female scattering flowers in the foreground, encircled by the words: "Great Seal of the State of Florida: In God We Trust," be and the same is hereby adopted as the Great Seal of the State of Florida, and immediately after such seal shall be prepared for use, the Governor shall issue his proclamation announcing that the same has become the Great Seal of the State.
