RESOLVED, That a joint committee of three members of each house be appointed to superintend the printing.

RESOLVED, That hereafter unless otherwise specially ordered by either house, the prices paid for folding, stitching, cutting, and covering the documents, pamphlets, and journals of either house, shall be at the rate of fifty cents per hundred copies, where the said pamphlet or document contains one sheet and no more; for any number of sheets more than one and not more than three, at the rate of seventy-five cents per hundred copies; for any Extra sheets number of sheets more than three and not more than seven, one dollar and twenty-five cents per hundred copies; and for every extra sheet over seven, twenty-five cents per hundred Extra covers copies; extra for covers fifty cents per one hundred copies; for folding, cutting, stitching, and covering journals, at the rate of twenty cents per one hundred sheets.

RESOLUTION

Granting the Trustees of the Lumberman's Bank further time to wind up

its Affairs.

RESOLVED, By the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, That the provisions of the resolution of the twenty-fourth of June, one thousand eight hundred and thirty-nine, in pursuance of which trustees were appointed to take charge of the Lumberman's Bank at Warren and wind up its affairs, be continued in force and extended to the first day of March, one compound &c thousand eight hundred and forty-two. That the said trustees shall have the right to compound and compromise all debts of a doubtful character; to receive and allow by way of set off, the liabilities of said institution when tendered by any of the debtors; and to receive any property, stocks, or other securi

ties at their fair valuation, in payment thereof, and dispose of the same in such manner as they may deem most advantageous for the interests of the creditors and stockholders of said institution. And that no attachment in any other state shall be received, construed, or adjudged as a bar or defence to any action instituted or to be instituted within this state, for the recovery of any of the debts due to said bank.

RESOLUTION

Relative to the Repair of the Delaware Division of the Pennsylvania Canal.

$70,000 appropriated

RESOLVED, By the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, That the canal commissioners be and they are hereby authorized and required, with as little delay as possible, to cause the Delaware division of the Pennsylvania canal, to be repaired, and that the sum of seventy thousand dollars shall be and the same is hereby appropriated out of any moneys not otherwise appropriated toward that purpose; Provided, That all dams, acqueducts, and locks, the estimated cost of Proviso which for rebuilding or repairing shall exceed the sum of two thousand dollars, and all bridges that are to be built or rebuilt on the said canal, shall be let by contract to the lowest and best bidder or bidders, after due and public notice of not less Repairs let to than fifteen days of the intended lettings of said portions of lowest bidder work: And provided further, That all acqueducts and locks that require to be rebuilt on the Delaware division of the

Pennsylvania canal, shall if the canal commissioners deem the Dimensions of same expedient, be constructed of such dimensions as to permit Locks, &c boats of one hundred and twenty tons burthen to pass through.

RESOLUTION

Relative to the claim of Philip Sullivan, David H. Lochart and Franklin
Stratton.

WHEREAS, It is represented that Philip Sullivan, late a contractor for section number sixty-six, on the Tunkhannock line of the North Branch canal, has suffered great loss in conse quence of coming in contact with an item of work not embraced or mentioned in his article of agreement, to wit: a solid cemented gravel, usually called hardpan, as difficult to excavate as rock itself, and could only be removed at great labor and expense, nearly or quite double that for which common earth could be removed;

And whereas, It is further represented that it is not competent for the canal commissioners to grant him relief without 2d preamble express authority is given to them for that purpose by the legislature; therefore,

RESOLVED, By the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, That the canal commissioners be and they are hereby authorized and required to examine the claim of the said F Sullivan's Philip Sullivan for additional compensation for work done on the said section and allow him such sum as to them shall appear just and equitable, without regard to the terms of his original contract, so far as relates to the item of work not embraced in said contract: Provided, That if no compensation in addition to the contract prices shall be authorized and allowed by the canal commissioners upon such examination, then and in that case any extra additional cost and expense incurred thereby shall be borne and defrayed by the said Philip Sullivan.

DH Lochart's claim

RESOLVED, That the canal commissioners are hereby authorized and required to examine the claim of David H. Lochart, a contractor on the French Creek division, and to ascertain whether the said Lochart sustained any damages in his contract for the construction of lock number seven on said French Creek division, in consequence of the closing of the gates of lock number eight on said division, against the consent of said Lochart, and also to examine the claim of said Lochart for Extra work extra work and for changes made in the work of said contract, and to make a fair and equitable adjudication upon said claims, and if any damages are awarded, the same shall be paid out of any unappropriated money in the treasury.

WHEREAS, A resolution passed on the first day of April, one thousand eight hundred and thirty-six, authorized the canal commissioners to adjust and settle the claim of Franklin Stratton, a contractor on the French Creek division of the Penn- Preamble sylvania canal, on account of losses sustained by a change in the location of a dam and guard lock, and also empowered the auditor general to audit and settle the same, but made no provision for the payment of the amount found due;

And whereas, On settlement made with the canal commissioners, under the provisions of said resolution, a balance of 2d preamble one thousand and seventy-five dollars was found justly due said Stratton; therefore,

RESOLVED, By the Senate and House of Representatives

of the Commonwealth of Pennsylvania, in General Assembly met, That the state treasurer be and he hereby is required to F Stratton's pay the amount found due the said Franklin Stratton, under claim the resolution aforesaid, out of any moneys in the treasury not otherwise appropriated by law.

RESOLUTION

Relative to the Bridge over the West Branch of the Susquehanna at
Karthaus, belonging to the Commonwealth.

RESOLVED, By the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, That in lieu of the tolls authorized to be charged by the president and managers of the Milesburg and Smithport turnpike road company, by the resolution making an appropriation charge tolls to erect a bridge over the West Branch of the Susquehanna at Karthaus, passed on thirteenth of June, one thousand eight hundred and forty, the said president and managers are hereby authorized and required to demand and collect from travellers and others crossing said bridge, for the use of the Commonwealth, the following rates of toll, viz: for every carriage or wagon used for the purpose of agriculture, having four wheels,

ten cents for each horse drawing the same; for every carriage or cart used for the purpose of agriculture, having two wheels, six and a quarter cents for each horse drawing the same; for every carriage used for personal accommodation or pleasure having four wheels, twelve and a half cents for each horse drawing the same; for every carriage having two wheels used for personal accommodation or pleasure, twelve and a half cents for each horse drawing the same: for every sleigh or sled, ten cents for each horse drawing the same; when wagons or carriages are drawn by oxen, or partly by oxen and partly by horses, two oxen shall be rated as one horse for every mule, horse, gelding, or mare, if without a rider, three cents; for the same with a rider, six and quarter cents; for every head of horned cattle, one cent; for every score of sheep or swine, ten cents; for every foot passenger, two cents; for every stick of timber, which may be drawn over said bridge, if the same be not loaded on a wagon, fifty cents: Provided, That no toll shall be charged for any person attending funerals, divine worship, or schools. And the president and managers of the said turnpike road company, are hereby authorized to appropriate five hundred dollars of the first tolls which may be collected, to the purchase of a lot of ground adjacent to the bridge, for the use of the commonwealth, and erecting thereon a building suitable for the accommodation of the collector of tolls, and to rent the same, before they pay into the state treasury any portion of tolls as is provided in the original resolution.
